Medical Malpractice

As consumers of healthcare services, we put our trust in the medical professionals that treat us. We expect them to follow the standards of care that their profession and their licensing authorities demand. Fortunately, most of the time, medical professionals meet or exceed the standards of care to which they are bound. Occasionally they fail, and as a result of their failure their patients can suffer serious and catastrophic injuries and, regrettably, death. I have and continue to represent those who have been victims of medical negligence. By vigorously pursuing medical malpractice cases, lawyers act as a check on those healthcare providers who deviate from the standard of care while at the same time informing healthcare professionals that they must be attentive to their training.

Workers’ Compensation

For over 100 years workers have been protected by state workers’ compensation laws. If you are injured on the job, in the vast majority of cases, your employer is responsible for three things:
1) Your employer must provide and pay for your work related injury medical expenses. 2) Your employer must pay you a temporary total disability benefit while you are off of work. 3) Your employer must compensate you for any permanent partial or permanent total disability you suffer as a result of the work related injury. Because of the prevalence of drugs in our culture, legislatures across the country have taken away some employee workers’ compensation benefits if it is determined that the employee was under the influence of non-prescription/illegal drugs at the time of injury. 

Nursing Home Negligence

Many of you reading this either know someone who is in a nursing home or is thinking about moving into one. It is a poorly kept secret that nursing homes face serious staffing shortages, in part, because wages are so low that the best and the brightest choose not to work there. Unfortunately, many nursing home residence do not receive the care they need because of staffing issues. The most common, but preventable injuries that nursing home residents suffer, are falls; decubitus ulcers; also known as pressure sores and bedsores, and malnutrition. Motor Vehicle Accidents

Over 36,000 people die in motor vehicle crashes every year. This, of course, does not take into account the tens of thousands of people who suffer serious and life-long injuries. There is no question that vehicles are safer to drive and withstand crashes today than at any time since the first Model T came off the assembly line. Yet, because of cell phones and other portable devices, more drivers are distracted while driving than at any time in history, resulting in inevitable crashes. If you are involved in a crash, although you may have an obligation to report the crash to your insurance company, do not, under any circumstances, talk to the at fault drivers insurance company’s representative. Understand that he is not your friend and that his only job is to minimize the amount his employer is going to pay. He is more concerned about the shareholders of his company than seeing to it that you receive fair compensation for your injuries.

Criminal Defense

The first person I ever defended who was charged with a criminal offense was 43 years ago; I have been representing criminal defendants ever since. If you or someone you know has been arrested, ask to speak to a lawyer. Do not, under any circumstances waive your Sixth Amendment right to a lawyer. You might think that you are helping yourself by cooperating with the police, but more than likely you are not. What you are doing by speaking up is giving the police ammunition that might strengthen, not weaken, the case against you.
